Terms of service.

These Terms of Service ("Terms") are an agreement between you and Taybuta, Inc., a Wyoming corporation with its principal place of business in Colorado, doing business as Bagpipe Golf ("Bagpipe Golf", "Taybuta", "we", "us"). They govern your use of the Bagpipe Golf mobile app, the bagpipegolf.com website, and any related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to create an account. If you don't meet this requirement, do not use the Service.

Access to wagering, side-bet, and tournament-payout features is restricted to users who are at least 18 years old (or the age of legal majority in their jurisdiction) and legally permitted to participate in wagering activities where they live. By using those features, you represent that you meet both requirements.

You own the data you enter into the Service: your scorecards, bet records, tournament results, profile information, and any photos or text you upload.

By using the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display your content in connection with operating, improving, marketing, and expanding the Service and our other products.

You represent that you own or have the necessary rights to the content you submit, and that it doesn't infringe anyone else's intellectual property rights or violate any law or right of privacy.

5. AI features

The Service may include AI-powered features (for example, shot recommendations and post-round summaries via the "AI Caddie" feature when enabled). The AI Caddie is currently disabled in this build of the app. This section applies whenever the feature is re-enabled.

AI output is generated probabilistically and may be inaccurate or inappropriate for your situation. Use your own judgment — the AI Caddie is for entertainment and should not be relied on as professional coaching. We do not guarantee that AI output will improve your scoring.

6. Side bets and tournaments — money handling

Bagpipe Golf includes side-bet and tournament scoring features that track money flow between players. Bagpipe Golf does not hold, transfer, or process money. Players settle wagers between themselves outside the app. We compute who-owes-whom and display the result; we do not act as a payment processor.

You are solely responsible for ensuring that your bets and tournaments are lawful in your jurisdiction and that you handle the resulting payments lawfully (including any tax obligations). If you choose to invite others to bet, you represent that all participants are eligible to participate in those bets where they live.

If we add real-money handling in the future (for example, via a licensed payment processor), these Terms will be updated to cover that capability before it goes live.

By creating an account, you agree to receive transactional emails from us (account confirmations, password resets, security alerts). You can disable push, SMS, and other in-app notifications per category at Profile → Notifications. Transactional account emails (sign-in security, account-deletion confirmations) cannot be disabled while your account is active.

9. Our intellectual property

The Service — including the app's source code, design, branding, underlying scoring/betting engine, and humor mechanisms (such as Rage Mode) — is owned by Taybuta, Inc. and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute it except as expressly allowed by these Terms or by law.

The Bagpipe Golf name and logo are trademarks of Taybuta, Inc. Don't use them to suggest endorsement of your event, club, or product without our written permission.

10. Third-party services and content

The Service integrates with multiple third-party providers (course data from GolfCourseAPI.com, AI from Anthropic when the AI Caddie is enabled, push delivery from Firebase, etc.). We don't control these third parties and we're not responsible for their content, accuracy, or availability. Your use of those third-party services is also governed by their own terms.

Course names, ratings, slopes, and pars are sourced from external providers and may contain errors. Verify with your course operator if anything looks wrong. We are not responsible for scoring discrepancies caused by inaccurate course data.

Downstream developers and API access

If we grant a third-party developer, tournament-management partner, or course operator access to our API, an SDK, or other integration, that access is governed by a separate agreement between us and that party, in addition to these Terms. Any such downstream party must handle data obtained through that access consistent with both our Privacy Policy and their own posted privacy policy, and may not use the API or the associated agreement in a manner that conflicts with either. Bagpipe Golf, its parent company Taybuta, Inc., and any other facility or LLC owned by Taybuta, Inc. disclaim all liability for a third party's improper, unauthorized, or unlawful use, storage, or disclosure of data obtained through such access — responsibility for that misuse rests solely with the third party who committed it, not with us.

You agree to defend, indemnify, and hold harmless Taybuta, Inc. and its officers, employees, and agents from any claim arising out of:

14. Disputes and arbitration

Please read this section carefully. It requires binding arbitration of most disputes on an individual basis, and waives your right to a jury trial and to participate in class actions.

Informal resolution first. Before starting a formal proceeding, you agree to contact us at the address in §15 and try to resolve the dispute informally for at least 60 days.

Governing law. These Terms and any dispute arising out of or related to these Terms or your use of the Service are governed by the laws of the State of Colorado (Taybuta's principal place of business), without regard to conflict-of-law principles.

Arbitration. Except as set out below, any dispute, claim, or controversy arising out of or relating to these Terms — including its breach, termination, enforcement, interpretation, or validity, or your use of the Service — will be settled by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules (or, for consumer disputes, its Consumer Arbitration Rules), conducted in Denver, Colorado. Judgment on the arbitrator's award may be entered in any court with jurisdiction. The arbitrator applies Colorado law and has exclusive authority to decide disputes about the arbitrability or enforceability of this clause. Arbitration is conducted individually — not consolidated with any other arbitration.

Class-action waiver. You and Taybuta each agree that any proceeding to resolve claims will be conducted only on an individual basis, not as a class, consolidated, or representative action. If a court finds this waiver unenforceable for a particular claim, that claim proceeds in court and all other claims proceed in arbitration.

Opt-out. You may opt out of this arbitration agreement by sending a written notice to the address in §15 within 30 days of first accepting these Terms. Your notice must include your name, the email address associated with your account, and a clear statement that you want to opt out.

Exceptions. Either party may seek emergency injunctive relief in a court of competent jurisdiction in Denver, Colorado to prevent irreparable harm pending arbitration (including IP infringement claims). Both parties consent to personal jurisdiction there for that limited purpose. Nothing in this section prevents you from filing a complaint with a consumer-protection authority or in small-claims court where allowed.

Time limit. Any claim arising out of or related to these Terms or the Service must be brought within one (1) year after the claim arose, or it's permanently barred.
